1. Agreement
These Terms and Conditions ("Terms") govern your use of warehousing and storage services provided by Sawera Traders ("we", "us", or "our"). By engaging our services, you ("Client" or "you") agree to be bound by these Terms.
2. Service Description
Sawera Traders provides warehousing and storage services including but not limited to:
- General merchandise warehousing
- Furniture storage
- Automobile storage
- Chemical storage (with proper permits)
- Textile storage
- Foreign trade zone storage
- Inventory management
- Loading and unloading services
3. Storage Agreement
All storage arrangements require a written agreement specifying:
- Description and quantity of goods
- Storage duration and rates
- Special handling requirements
- Insurance and liability terms
- Payment terms and conditions
4. Acceptance of Goods
We reserve the right to inspect and refuse acceptance of goods that:
- Are not properly packaged or labeled
- Contain hazardous materials without proper documentation
- Are illegal, stolen, or contraband
- Exceed our facility's capacity or capabilities
- Are perishable without proper preservation arrangements
5. Client Obligations
The Client must:
- Provide accurate and complete information about stored goods
- Ensure proper packaging and labeling of all items
- Obtain necessary permits for hazardous materials
- Pay all fees and charges as agreed
- Comply with all applicable laws and regulations
- Maintain appropriate insurance coverage
- Provide 24 hours notice for goods retrieval
6. Payment Terms
Payment terms are as follows:
- Monthly storage fees are due in advance
- Additional services are charged separately
- Payment must be made within 30 days of invoice date
- Late payment charges: 2% per month on overdue amounts
- We accept cash, bank transfer, and checks
- All prices are subject to applicable taxes
7. Lien Rights
We have a lien on all stored goods for:
- Unpaid storage charges
- Handling and service fees
- Insurance premiums
- Any other charges related to storage
We may sell goods under lien after 60 days written notice if charges remain unpaid.
8. Liability and Insurance
Our liability is limited to:
- The actual cash value of goods at time of loss
- Maximum of Rs. 1,000 per kilogram unless higher value is declared
- Declared value with additional insurance premium paid
We are not liable for:
- Mysterious disappearance
- Acts of God or natural disasters
- Inherent vice or natural deterioration
- Damage from insects, rodents, or vermin
- Loss due to inadequate packaging
9. Access and Security
Access to stored goods is subject to:
- Business hours: Monday-Saturday 9:00 AM - 6:00 PM
- Sunday: 10:00 AM - 4:00 PM
- 24-hour advance notice for retrieval
- Proper identification and authorization
- Accompanied access by our personnel
- Security protocols and procedures
10. Termination
Either party may terminate storage agreements:
- With 30 days written notice
- Immediately for breach of terms
- For non-payment of charges
- For storage of prohibited items
Upon termination, goods must be removed within 15 days or additional charges apply.
11. Force Majeure
We are not liable for delays or failures caused by circumstances beyond our control, including:
- Natural disasters
- Government actions or regulations
- Labor strikes or disputes
- Transportation disruptions
- Power failures or utility disruptions
12. Indemnification
The Client agrees to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Breach of these terms
- Negligent or wrongful acts
- Storage of prohibited items
- Violation of laws or regulations
- Third-party claims related to stored goods
13. Modifications
We reserve the right to modify these terms at any time. Changes will be:
- Posted on our website
- Effective 30 days after posting
- Communicated to existing clients
- Applicable to new storage agreements immediately
14. Dispute Resolution
Any disputes arising from these terms shall be resolved through:
- First: Direct negotiation between parties
- Second: Mediation by mutually agreed mediator
- Third: Arbitration under Indian Arbitration Act
- Final: Courts of competent jurisdiction in Dumka, Jharkhand
15. Governing Law
These terms are governed by:
- Laws of India
- State laws of Jharkhand
- Applicable central government regulations
- Local municipal laws and ordinances
16. Severability
If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
